The Government Emergency Ordinance no. 25/2021 on amending and supplementing some normative acts in the field of public procurement was published in the Official Gazette of Romania, Part I, number 346.
The ordinance modifies the national legislative framework by regulating some aspects related to the participation of third country operators in public procurement procedures.
Government Emergency Ordinance no. 25/2021 amends and completes the following normative acts:
• Law no. 98/2016 on public procurement, with subsequent amendments and completions;
• Law no. 99/2016 on sectoral procurement, with subsequent amendments and completions;
• Law no. 100/2016 on works concessions and service concessions, with subsequent amendments and completions.
This change also affects the procurements performed by the beneficiaries from Ukraine
The Managing Authority, with the support of TESIM, will update in the forthcoming period the Instruction for beneficiaries no. 2 of October 2020, with subsequent modifications, laying down specific provisions for beneficiaries regarding the expenditure verification of a grant contract funded under the ENI CBC Joint Operational Programme Romania –Ukraine2014-2020.
